Ultimately, you are going to need to prove by a preponderance of the evidence, and what that generally means is by 51%, that your employer treated you differently because of a protected characteristic, such as you being a woman or you being African American or a Muslim. The way in which that can be done and proven is generally through circumstantial evidence showing that you are a member of a protected class, that you were denied a promotion, for example, and that the reason that your employer gave for why it denied you that promotion, was actually just a pretext for discrimination. If you prove all of those elements by a preponderance of the evidence, you should be able to win your employment discrimination case.
