Ten years after Congress created the SEC whistleblower reward program, 2020 has been a very busy year for the program.  The SEC made a record 39 individual awards of approximately $175 million and adopted significant amendments to the rules governing the program.  This panel will offer insights and practice tips on the new rules and discuss the impact of the SEC whistleblower program on SEC enforcement and corporate compliance.  Among the rule changes addressed will include the new process governing the determination of award percentage, the “original information” standard governing independent analysis submissions, the scope of covered actions that qualify for awards, new procedures that expedite the processing of award applications, the bar against multiple recoveries, and the scope of Dodd-Frank whistleblower protection. The panelists will also address best practices for companies responding to internal whistleblower tips and SEC investigations of whistleblower tips, and best practices for whistleblowers reporting fraud to the SEC.
