Can I sue an individual under the Sarbanes-Oxley Act?

Yes. Unlike many of the anti-retaliation laws, the anti-retaliation provision of the Sarbanes Oxley Act authorizes claims not only against an employer, but also against the individuals who were responsible for the unlawful adverse employment action. This includes officers, employees, and directors.
